Brief update:
All accused except the 12th accused was present before the court .
The 17th accused has passed away.
A new bench was appointed and all accused were represented.
However, it was brought to the attention of the court that the 12th accused was sick and has been admitted to the Ragama hospital. Further, a letter was sent by the Mahara Prison informing the court of this fact.
The state counsel informed court that the matter cannot be taken up for trial as the consent has not been obtained from the accused to proceed in his absence. The attorney appearing for the accused stated that no such instructions were given.
The presiding judge directed the counsel for the 12th accused to get his consent in writing to proceed with the matter in his absence, in the event that the accused cannot be present on the next date and further ordered for his medical reports to be presented to the court on the next date.
Witness no. 2055 and 2056 are to be issued summons .
Matter was fixed for trial on the next date
