-1st Accused Hijaz Hezbollah and 2nd Accused Mohomad Shakeed appeared in the court.
– Prosecution witnesses No.46 was released temporarily.
– Prosecution witnesses No.58 and 59 were presented.
– The Evidence in Chief of the prosecution witnesses No. 58. was started.
– The learned counsel for the 1st accused raised an objection when the state counsel was going to show the album which was in the cover, marked as the “P 4 (a)” to the prosecution witnesses No. 58 and ask questions.
– Accordingly, the learned counsel for the 1st accused recorded his objection by denoting the reasons why the state counsel cannot lead evidence in chief from the aforesaid witnesses by using that album and whereas the state counsel recorded her oral submission denoting how evidence ordinance in Sri Lanka is applied in a situation like this and why the state counsel intended to show and ask question from the said album.
-The learned High Court Judge Ordered to the state counsel to handover a copy of the said Album to the learned counsels for 1 st and 2nd accused and a calling date was given to delivery the order regarding whether the state counsel is entitled to ask question by using the so called album or not.
-Prosecution witnesses No.58 was warned and prosecution witnesses No. 59 was released temporarily.
Next dates- 2024/12/13 for the order regarding whether the state counsel is entitled to lead evidence from prosecution witnesses No.58 by showing the so called album which was kept inside of the cover marked as “P 4(a)” and 2025/01/10 for further trial
