This matter came up for support on 14th October 2025, in 303, before Justices Corea and Gopallawa.
Ms. Ermiza Tegal AAL, with Mr. Suren D. Perera AAL, and Ms. Linuri Munasinghe AAL instructed by Ms. M. Manushika Kasuni Cooray AAL appeared for the Petitioners. Mr. Janaka Bandara DSG appeared for the 1st and 3rd Respondents, and Mr. Chandaka Jayasundere PC appeared for the 2nd Respondent.
DSG Janaka Bandara submitted to court that the State had appealed against the HC TAB judgment re the Easter Attack to the Supreme Court, and that a retrial had been ordered. He further submitted that the 2nd Respondent was a material witness in the HC TAB case, and that to his knowledge, no criminal investigation that had been initiated against him. Ms. Tegal stated that the 2nd Respondent’s status as a witness had no material bearing on the application which is seeking the institution of criminal proceedings against the 2nd Respondent.
Mr. Jayasundere PC submitted to court that the National Police Commission had delivered an inquiry report finding the 2nd Respondent guilty of the charges levelled regarding his dereliction of duty in relation to the Easter Attack, and dismissed the 2nd Respondent from the Police Department. He further submitted that the above decision had been appealed against to the Administrative Appeals Tribunal, and that an order pertaining to the same was due in February 2026.
Court deemed it prudent to refix the matter, so that it may be supported subsequent to the aforementioned developments coming to light. Court recorded that the Petitioners were now solely pursuing prayers seeking the institution of criminal proceedings against the 2nd Respondent.
