Court: Special Permanent Three-Judge High Court (Trial-at-Bar), Colombo 12.
All the accused, except the 17th accused who has passed away and 9th accused who is sitting for LLB exam, were present today. The 1st, 2nd, 7th, 8th, 9th, 10th, 12th, 13th, 15th, 18th, 19th and 20th to 25th accused were represented and the others appeared in person. The voir dire inquiry of the 12th accused continued today.
From the additional list of witnesses of the defence, PW 19, 11 and 01 was present before the court. PW 19 is a Navy officer but there were no records available for the period that defence wanted to prove. The witness was not cross-examined. PW 11 is the OIC of TID. The witness has brought the book where information about the visit of the family members of the suspects are entered. But the entries needed for the defence was not available and the defence questioned the witness aggressively. The prosecution cross examined the witness and certain portions of the entries in the book were marked by the defence and the prosecution. PW 01 is a JMO who examined the witness and he testified that he didn’t notice any wounds in the body of the accused.
After closing the defence case, prosecution called, PW 2, 8, 5 and 3 of the additional list of the prosecution. PW 2 gave evidence that he was told by the 12th accused that he needs to meet a higher officer and also the actions taken by him in that regard. PW 8 has directed the accused to the ASP to make the statement. PW 5 also stated that the accused mentioned him that he needs to meet the previous higher officer to make a statement. PW 3 mentioned that he accepted the accused to Upasewaya after bringing him from Colombo. All the witnesses were cross-examined.
The court issued summons to PW 4, 6, 7, 15, 17, 18, 19 and 20 of the additional list of the prosecution to be present before the court tomorrow. Further PW 21 and 22 were added to the list.
