184th Day of the Main Easter Attack Trial – HC (TAB) 2972/21

Venue: Special Permanent Three-Judge High Court (Trial-at-Bar), 2nd Floor, MCC Building, Adhikarana Mawatha, Colombo 12.
Except the 17th accused who has passed away, rest of the accused were present before the court. The voir dire inquiry of the 1st accused continued today and the cross-examination of the 1st accused proceeded. He was questioned about the letters he has written to his wife while in detention and his medical documents was also re-examined.
Another witness was summoned from the Police Commission, however, the evidence was limited to the fact that a complaint was made to the Commission since the Commission has immunity from legal proceedings as per A.155C of the Constitution. The 3rd accused cross-examined the witness.
The Registrar of Magistrate Court 03 of Colombo was summed to give evidence regarding the journal entries of case no. 48788/3/21. However, the case record has been sent to Homagama High Court and the intended journal entries were not in the sub file brought by the witness. The witness was not cross-examined.
PW 1 of the 1st accused’s witness list, who was a Jailor from Bussa Prison was summoned and he was cross-examined by the 9th accused and the prosecution. The 1st accused finished his case and the prosecution tendered a list of witnesses including 11 witnesses.
PW 11 of the prosecution witness list was summoned and he was the TID officer who typed the statement of the 1st accused which was made under S.16(1) of PTA. He was cross-examined by the AAL for the 1st accused and by the 3rd, 4th, 9th and the 5th accused.
The rest of the witnesses in the witness list of the prosecution will be called tomorrow. The prosecution intends to commence the voir dire inquiry of the 18th accused afterwards.
